1. Agreement to Terms

By downloading, installing, or using the AeChai mobile application or visiting the aechai.org website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

AeChai Inc ("AeChai", "we", "us", "our") reserves the right to update these Terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

AeChai is an air quality monitoring platform that connects to a Bluetooth Low Energy (BLE) air quality sensor to display real-time PM2.5 and PM10 particulate matter readings. The app also provides an SOS emergency alert system that sends SMS notifications with your location to designated guardians and enables live GPS tracking during emergencies.

3. Eligibility

AeChai is intended for users aged 13 and above. By creating an account, you represent that you are at least 13 years old. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

4. Account Responsibilities

  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate information when creating your account and adding guardian contacts.
  • You must not share your account with others or create multiple accounts.

5. Emergency Features Disclaimer

The SOS alert system is designed to assist in emergencies by notifying your designated guardians via SMS and sharing your location. However:

  • AeChai is not a substitute for emergency services. In a life-threatening situation, always contact local emergency services (e.g. 112 in Ghana) first.
  • SMS delivery depends on third-party providers and cellular networks. We cannot guarantee that alerts will be delivered instantly or at all.
  • Location accuracy depends on your device's GPS hardware, signal availability, and whether location permissions are granted.
  • AeChai is not liable for any failure, delay, or inaccuracy in the delivery of emergency alerts or location data.

6. Air Quality Monitoring

  • Air quality readings are provided by the AeChai BLE sensor device and classified according to WHO 2021 Global Air Quality Guidelines. These readings are for informational purposes only and do not constitute medical or health advice.
  • Sensor accuracy depends on hardware calibration, device condition, and environmental factors. We do not warrant the accuracy of any reading.
  • Do not rely solely on AeChai readings to make health decisions. Consult a medical professional if you have health concerns related to air quality.

7. BLE Device Usage

  • The AeChai BLE sensor device is designed to be used with the AeChai app. Modifying or tampering with the device firmware may void any applicable warranty and produce unreliable readings.
  • Bluetooth connectivity requires the device to be within range and your phone's Bluetooth to be enabled.
  • The device requires periodic charging. AeChai is not responsible for interruptions caused by a depleted device battery.

8. Acceptable Use

You agree not to:

  • Use the SOS feature for non-emergency purposes or to harass, intimidate, or alarm others
  • Provide false guardian contact information
  • Attempt to access another user's account or data
  • Reverse-engineer, decompile, or tamper with the app or its backend services
  • Use the Service in any way that violates applicable laws or regulations

9. Intellectual Property

The AeChai app, website, branding, and all related content are the property of AeChai Inc. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our written permission.

10. Privacy

Your use of AeChai is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

11. Account Termination

You may delete your account at any time from the app (Profile → Delete Account). See our Account Deletion page for details.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior, including misuse of the SOS system.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of Liability

To the fullest extent permitted by law, AeChai Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages arising from the failure of emergency alerts, inaccurate air quality readings, or interruption of service.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ghana.
